    I am working for company A on H1 which is valid until November 2010. I would like to work for Company B on EAD, since company B would not do H1
    To be on the safer side, I would to like have another H1 from company C, so that if anything happens with I-485, I can join company C on the H1.
    Is this possible? Do I have to travel out of country in order to work for company C on H1?

    In some of the forums I saw that, we can go to H1 from EAD as long as our H1B is unexpired. Pls let me know what you know about this.

    I have been denied US Student Visa thrice before. But that was about 10 years ago in 2001. I have only 2 stamps in my passport showing "application received" because third time was by mail and passport was not required to be sent.

    I have to apply for UK DATV visa as am travelling to europe with family via UK. No stayover in UK though.. just 5 hours wait each way on same terminal to change planes.

    In application for UK DATV visa, should I mention 2 refusals or all 3, since there are only 2 stamps of "application receipt" on passport? Can these refusals have any impact on my DATV visa? I have been living in the USA since and current have I485 pending with valid EAD and AP.

    Any suggestions or experiences would be helpful please.

    My I 140 was filed recently online. I noticed that we missed out Part 4.2 where it ask for Permanent address abroad. Does anyone know if this will be an issue?

    Some members quoted that they hold a second H-1B. Because these second H-1Bs do not fall under any quota, this is a USCIS given gift for us, considering how slowly they process our applications.

    I plan on taking up a part-time H-1B job on hourly basis. Please give me any suggestions you have.

    Across the ideological spectrum, House Speaker Nancy Pelosi has dashed expectations.

    On the right, the hope was that Pelosi would be the tallest lightning rod in Washington � playing to type as a �San Francisco liberal� and handing the Republican minority all manner of ideological openings to exploit. For the most part, that has not happened.

    On the left, the hope was that Pelosi would lead the newly empowered Democrats to hijack President Bush�s agenda on the issue that matters most to party activists � ending the Iraq war.

    To Pelosi�s regret, that has not happened either.

    Appraisals of Pelosi�s first year revolve around these fallen hopes and come with still another surprise: For all her history-making status as the first woman to run the House, Pelosi has emerged as a fairly conventional leader.

    This is partly to her credit.

    She has run a highly disciplined operation, keeping a potentially fractious caucus unified on tough issues.

    And she has restrained some of her own instincts representing one of the nation�s most liberal districts.

    With a couple of prominent exceptions, she has not handed Republicans opportunities to exploit impolitic statements or legislative maneuvers.

    But conventionality has come at a steep cost.

    Few members of either party, when speaking privately, argue that what Congress needs most is a change of party with a continuation of the highly partisan status quo.

    In many ways, that�s what Pelosi represents.

    Democrats bridled at being marginalized under 12 years of Republican rule, but Pelosi has treated turnabout as fair play.

    Bending a promise made to voters in the last election, the speaker has shut Republicans out of many debates by limiting their ability to offer alternative ideas on the House floor and made only modest attempts to engage Republicans on many issues, notably Iraq.

    This represents a probably accurate calculation about what�s necessary to keep her own party cohesive.

    But polarized government has also thwarted some of Pelosi�s own objectives.

    The first of those is forcing Bush to end the war. �All of the good things that we did, which were, I mean, astounding � are eclipsed by the war in Iraq,� she said in a Politico interview.

    She added that she has been surprised by Democrats� inability to peel off GOP dissenters.

    �If I had to say one thing that I would have appraised differently � it would have been that I would not have expected the Republicans in Congress to stick with the president on this war this long,� she said. �Not from their personal statements to us privately or the public mood in their own districts.�

    The inability to resolve the Iraq debate or tackle the other most pressing issues is one reason the number of people saying they disapprove of the performance of Congress � at 70 percent in some recent surveys � has risen 15 to 20 points or more since the start of the year.

    Pelosi acknowledged she and her leadership team could have done better at managing expectations.

    �Maybe we should have been thinking about how we were communicating with the public more,� she said. �Maybe I should have from the start just established what we were doing instead of having to be responsive to the press about �somebody said this, they thought you were doing that,� because this place is a total rumor mill.�

    Even so, Pelosi made clear that she is fine with drawing sharp, partisan lines when necessary.

    �I certainly want my speakership to be distinguished by a level of civility and bipartisanship when that�s possible,� she said. �That is what I hope to do in this next year, I really do.�

    But as for this year? �I had a job to get done this year,� she said. �I had a decision to make; I had to remove obstacles to getting a job done.�

    She got it done, at times.

    Early in the session, Democrats moved their �six for �06� package promised in the previous election. That included raising the minimum wage, enacting homeland security upgrades and reducing student loan rates.

    They also helped their members by pushing for more spending on children�s health care, a political no-brainer for many members, and demanding that Congress offset the cost of new spending with spending cuts or revenue increases elsewhere.

    Along the way, the elegantly styled speaker, a grandmother of seven, proved herself a steel magnolia � a self-confident leader who projected strength in a way that caused powerful subordinates to defer to her.

    Even Vice President Cheney complimented (in a distinctly backhanded way) her leadership, noting he was surprised that such old Democratic bulls of the House as Reps. John P. Murtha of Pennsylvania and John Dingell of Michigan seem to follow her lead.

    �They are not carrying the big sticks I would have expected,� Cheney told Politico.

    �There�s a woman who runs that place with an iron hand,� Senate Majority Leader Harry Reid told Politico in an interview. �I am sure that some people are a little disappointed [that] this diminutive, very attractive woman is bowling people over � men and women.�

    Pelosi has succeeded in part by having her own team of old bulls, such as Rep. George Miller of California, and younger bulls, such as Rep. Rahm Emanuel of Illinois, on her team.

    What is sometimes called a weakness � a penchant for micromanaging, for instance � has helped tighten her grip and enhance her standing.

    She has muffed up on a few high-profile occasions. A trip to Syria earlier this year was ridiculed by Republicans as clumsy, freelance diplomacy.

    She was forced by her Democratic colleagues to quit pushing for the Armenian genocide resolution because it was clearly complicating U.S. relations with Turkey.

    The final verdict on her handling of the Iraq debate awaits the year ahead � whether Democrats can either force a change in policy or make Republicans pay a heavy price in the 2008 elections.

    For now, the best grade Pelosi can get is incomplete: Democrats have had no substantive success in changing policy.

    One what-if echoes. Some members say Democrats missed a golden opportunity early in the summer to find compromise and split Republicans from Bush, laying the groundwork for limits on the military operation.

    Pelosi instead pursued an unyielding approach that turned off even the war skeptics inside the GOP.

    In a sign of the pressures Pelosi is under, however, it is the anti-war liberals in her own party who offer the harshest assessment of the Pelosi reign so far.

    �When you look back at this year, it will be defined as the year of lost opportunities,� said Ohio Rep. Dennis J. Kucinich, a long-shot presidential candidate. �This was the time to use the power of the majority to chart a new direction. So far it�s been � not only a missed opportunity but a failure.�

    California Rep. Lynn Woolsey added: �I personally don�t think [the strategy] worked. As a result, everything we�ve done on student loans, minimum wage, the six in �06 agenda gets lost.�

    By one standard, however, Pelosi can look back on 2007 as a clear success. Her party is as well-organized, and her own position within it more secure, at year�s end compared with year�s start.

    �I am not going to let one issue blow up this caucus,� she said. �We always strive for unity.�

    Are you employed by a US firm. My only concern is that if you apply from indian and are out of US for an extended period of time, USCIS may assume that you have abandoned your immigration intent.

    Hi I'm a Moroccan citizen I was placed in removal proceedings (NY Buffalo) and took voluntary departure. once my wife's divorce was finalized we got married while on voluntary departure. we filed motion to reopen the case and it was reopened and transferred to Los Angeles, CA then the judge closed my case based on marriage with an I130 receipt without prejudice. The I130 was filed on june 2009 and was transferred to Los Angeles on November 12, 2009. I made an appointment with Info Pass but they just said you have to wait untill we call you. My lawyer said I can't file for the I485 untill the I130 is approved. My question is: How long will it take before we will be called for an interview?
    An estimation will be much appreciated thank you very much.

    Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...

    Anyone has any idea?

    I have approved I140 (EB3, PD:Nov'04) from previous employer; after getting my MBA (Jun'06), I have changed the job and my job description has also changed. New employer will file the labor after 3 months (HR Policy)..I have good relations with previous employer, they are ready to file I485. Is it possible to file I485(previous employer), while I am working with new employer?

    I am not sure but I came to know (not reliable source), that it is possible to file I485(previous employer) and during the interview, I can submit a support letter from the new employer. is this correct?

    Requesting your help..so near...but so far!!!!!

    Hi Friends,

    I work for a big 4 consulting firm and transferring my H1-B to a client (a 2 Billion dollar american company).......I'm planning to join my new company only after the visa has been transferred ........my questions are:

    1.) If the transfer is rejected, can I work for my current employer (assuming I dont resign)

    2.) My wife's on H4 and recently applied for COS from H4 to F1 - Do I need to file for her H4 transfer also or not?

    Not sure what's the effect of H1 transfer on wife's pending H4 to F1 application.

    Need help ASAP. Thanks a lot.

    I was laid off in Dec 2009, but severance will stop till early Feb. Now I found two potential jobs. Company A is a corporation in same state, but company B is a university in some other State.

    1. How long will take them to transfer my H1B? does the different States matter on this transfer time? I want to make sure which one can submit the H1B transfer before my paycheck stops in Feb.

    2. In order to apply for Green Card later, which job is better for Green Card application? I heard university will not help the staff (accountant) for Green Card application. Is that true?

    that is required to be maintained by the employer for all employees (even US Citizens)
    Yes on EAD you can/have to fill that

    I am a Indian citizen working in the technology sector on a H1B Visa. My 6 years on H1b in US are over. I have a approved I-140 and based on that I have a H1b extension for another ~2.5 years. My wife also works on a H1B Visa. I plan to go to school in the US for an MBA degree and will need to move to F1 Visa (student). Can I legally work in US after my education is complete in approximately 2 years time? Or do I need to move out of US before starting employment on either H1B or OPT (If these are allowed for MBA students)?

    You are extending your 4 th EAD and here we are fighting for the first EADeven our days are current ( of course changed them back) ....Be happy with where you are and contribute ..please dont start a new thread unless its a uniique issue

    Hello All,

    Being on H-1 never allowed you to get promoted unless the employer did all the necessary paperwork with USCIS/DOL. EAD being work authorization not limited to current employer, can EAD mean a little more freedom to waiting-for-GC H-1Bs in terms of being able to get promoted within the organization, get different job titles, etc ?

    Also, I have 140 approved and H-1B ext was granted for 3 years (till 2010). Does it make any sense to apply for EAD alongwith 485 ? If EAD gives the career advancement opportunities, can I apply for it but keep using my H-1B to re-enter US till 2010 if needed ?

    Any one had luck refiling I140 in EB3 for denied EB2 I140 (for same labor)?

    Also is it possible to request USCIS to change an EB2 I140 denied partition to EB3 during an appeal?

    It depends on several factors...
    Example PERM Job requirements, reason for 140 denial...etc

    Friends - anyone here who has applied in PERM where job required B.S + 2 - 4 yrs of experience? Mine is a Job zone 4(sr. software engineer), requires B.S + 30 months and in the PERM form the lawyer has entered 'No' to H12 question 'Is this normal requirements'. Were they right? Or should I be worried? Anybody can share any experience? Thanks!

    My sponsoring company received an Audit Letter from INS today. Is this the norm in today's scenerio when one applies for labor for a new Green card process?

    How alarming is it? What are its effects on Labor application?
