There is no issue what-so-ever using AP to enter US. I don't know why you are mixing H1 with AP. Both are different. AP is just a travel Document that can be used to travel abroad and return to US. Does not matter if you have a H1 or not.

Hi,
Can one apply for Admission in US University while one is on Visit Visa in USA ?
If yes, will he/ she get I-120 while staying in US ? or one has to leave USA to get I-120, apply for f1 visa and then come on that visa ?

Company A has filed my 485/EAD/AP. I am planning to change company B on AC21 after 180 days. Can I use AP which is filed by company A, for travel purpose after switching to Company B?

Interesting study. The headlines this morning around the country are on the subset of children of illegally present parents which Pew is estimating is about 7% of all children born in the US. It's not a surprise to see the GOP getting increasingly crazy as they know that in the long run they'll go the way of the Whigs unless they either convince Hispanic voters to support them or disenfranchise enough of them that they can continue to win elections with only Anglo voters.

Many of us repeatedly repeated the same repeating mesage to attend DC rally so that it can repeat in the EARS of all repeatedly whining GC seekers visiting repeatedly every immigration website repeatedly thinking that their GC will come some day. I have repeated the word repeat enough times but still want to repeat my message to you all, who want GC. Come to DC and contribute to IV. I repeat COME TO DC AND GET YOUR GC.

My I-140 was approved in August 2009 and my PD is Jan-2004 (EB3). I want to know when i can apply for I-485, should i have to wait till my PD becomes Current or is there any other way by which i can file the I-485. Please shed some light on this topic and thanks for your time and effort.

With the current market crisis, you never know when you will be out of job.
Though I have my H1B valid till 2011( my I140 is approved and is already over more than six months, 485 is pending), Most of the people suggesting me to apply for EAD.
1) What are the procedures I have to maintain ( in connection to USCIS and my green card application pending) if I change employer?
2)Can I also work for multiple employers on EAD?

1)Company A (GC sponsoring company) filed H1B 3 years extension based on approved 140 six months back and it is pending since then and got RFE .My previous H1B expired 3 months back.
2)Now i would like to switch company B by using AC21 and want to file H1B renewal also with company B.
Is it possible to file H1B renewal with company B by using pending receipt notice of H1B (that was filed by company A)? or do I need to wait until get H1B approval that was filed by Company A?
Experts please suggest?

I was searching on all programmer salary's on SalaryList.com (http://salarylist.com), it looks like we are much higher than the other majors, business analyst, finance analyst. So if I want to do AC21, in current condition, should I keep same salary? Several companies I talk to can only match now

I am on L1A visa which is valid till December 30 2010. My 7 year limit on L1A will end with that date. I have applied for Labor on October 20, 2009 with another employer (not with the one who has sponsored L1A). Since I applied for Labor (PERM) can I apply for new H1B petition now based on the receipt number ? Please advice. Thanks in advance for your help.

Hello,
It seems that I made a mistake in my DS-160 and my H1B got stamped with an error in my middle name. I repeated my lastname as my middle name so my full name appears as: 1stName 1stLASTNAME 1stLASTNAME 2ndLastname
I have a Tourist Visa also stamped wich is OK. Also the data on my passport.
My I797 is OK and everything else is OK.
I am still in my home country. Should I be worried about it? Should I try change it here or in the US?
In any event, what's the correct procedure to change it?

I checked from Tijuana site that if one has an appointment in Tijuana, then they will verify for PIMS entry for that petition.
Question --
1) How much does it cost to setup an appointment in Tijuana ? Do you need to pay the entire visa fee ($125) upfront during appointment ?
2) If the above is not true (and appointment can be set at a nominal cost), is it possible to set up an appintment, get PIMS verified and then cancel the appointment (I am planning for stamping in India)
3) If the above is doable , is it considered fraud -- any issues likely during stamping ? I believe it should not be, since they are anyway getting the additional money for setting up the appointment.

I have been residing in the U.S. (NY) since 0ct 2007 with an H4 visa. My dad had and still has an H1B visa. I have completed my high school here in the States only and now I am enrolled as a full time student in a college (in-state tuition). Now the problem is I will turn 21 this February and I believe I will no longer be a dependent on my father's H1 visa and would be residing "illegally". In that case what should I do? I want to complete my studies and stay here in the U.S. with my family and not be deported back to my home country all alone :(
Is changing to F1 a good option for me ? I heard it could be risky? Is there any way I could have my studies going smoothly as it is now considering the out state tution under F1 would be too much...
any suggestions and help would be greatly apppreciated
