I have I-140 with substitution pending since March of this year. Can I file for 485 now or do I need to wait for I-140 approval? Thanks.

Just called USCIS and told her that My application was mailed on Jun 28th and it got delivered on July 02. I also told her that my PD is May 2003 (hence i'm eligible to file in June)..
She told me that since i mailed it in June and this Notice goes into effect in July 02 my application WILL NOT be rejected... She asked me to wait for receipt notice :)

My application reached on July 2nd. When I asked the representative about the fate of my application, first she said I should be fine. When I told her that my application was received before DOS released the update and technically my application was received by USCIS when the bulletin was still current, she said that would depend on the descretion of that USCIS office.....funny but that's what she said. Again, she said that I could reapply in Oct and they will process the application then. But when I asked whether she was sure that VB will be current in Oct, she said USCIS doesn't know that.
So, the bottom line is.....there is no point in calling USCIS and asking them about the current fiasco as they themselves are unsure. You can still call them and you might hear something different but equally confusing.

You are right in acknowledging that you may be wrong. Where you may be wrong? Maybe your "opinion" that EB2 should be given GC first before a single EB3 is entertained. Maybe the first-come-first-served argument is the valid one after all.
How does "my" argument make sense? I say, ok, give priority to EB2, but only within the same year. So, last years' EB3 has to be allocated first, before this year's EB2/EB3 are considered. And for this year, dont process EB3's unless EB2's for this year are done

I called Kennedy and Cornyn. Asked them if they are aware of the issue. They are not. Did you call? Kennedy 202 224 4543, Cornyn 202 224 2934. I also aksed if Kennedy is going to send letters to two agencies as Rep Lofgren did as he is the senate immigration sub committe chair

BTW, The National Inquirer, who were the first to break the story of John Edwards affair has released the Plain story as well. I am not saying that this is real story or a false rumor. I am merely saying that this is out there and the fact is, John Edwards also denied the story in the beginning. But The National Inquirer has recently gained more credibility with being right on the John Edwards story.
Just to add, Not sure if this is true but there is news that Sarah Palin cheated on her husband, and had a relationship with the business partner of her husband. If this is true, then it would imply that she is not a good mother, she not a good wife and she is cunning & opportunist politician, with very little experience and a heartbeat away from her finger on the nuclear button when she is ready to go to war with Russia. Watch some 'Sarah Palin' youtube videos and see for yourself.
Now please don't call this "deep sexism", did anyone see Dick Morris around?

what is the phone number to call uscis regarding the july 2 query.
Called uscis and asked what happens to the app already received by them?
The rep put me on a hold..(guess went and asked somebody) and answered that all the app received will be put on hold(not returned) and said they will not process ead/ap too.Di anybody else tried calling and ask the same?did they tell the same thing?Just want to know if i interpreted it right?

Here is what Attorney Mathew Oh thinks about provisions for STEM.
Section 406. Visas for Individuals with Advanced Degrees: Section 406 exempts from the numerical cap on employment-based visas aliens with advanced degrees in science, technology, engineering, or math, and has worked in a related field in the U.S. during the 3 year period preceding their application for adjustment of status.
[Matthew Oh Comment: This benefit appears to apply not only to the U.S. earned advanced degree holders but also to those advanced degree holders who earned the degrees in the foreign countries as well.]
It also exempts immediate relatives of aliens who are admitted as employment-based immigrants from the numerical limitations of 203(b).
[Matthew Oh Comment: Exemption from the numerical limitation of spouses and children of EB immigrants and exemption from the numberical limitation of advanced degree holders in science, technology, engineering and mathematics with 3-year employment in the U.S. would practically make a substantially large addtitional numbers available to the total EB immigration numbers beyond the total cap of 290,000.]
Finally, it increases the available visas numbers for H-1B nonimmigrants and provides an exemption from the numerical limitation aliens who have earned advanced degrees in science, technology, engineering, or math.

With a due respect, I am differ with your statement on Competeamerica. Competeamerica has always promoted H1B and EB provision together. I haven't seen any time that they promoted only H1B.
I spoke with one guy at Competeamerica and he told me that IV is neutral on H1B issue eventhough all members have came through that root. Personally I am very positive with Competeamerica and it is not good for us to speak negative for this organization.
As the saying goes �the proof is in the pudding" anybody can give statements but it is the results that matter. What results has compete america achieved, they are just giving lip service. Contrast them with the health industry lobby which has achieved results year after year. Compete america ultimate goal is more h1b which they will achieve one way or the other.
Don�t get me wrong, I am not saying compete america is bad, I am just saying there focus is on H1b and not as much on EB relief. If they face a hypothetical situation where they can get either H1 or EB, they would gladly choose h1, that�s the bottom line. Its better to have somebody like compete america rather than nobody, but we need a corporate lobby whose main focus is eb relief.
And there is an important lesson to be learned from the health industry lobby. They just did not say they want CIR or skil and then went back when both cir and skil failed. They started chipping away at individual items like 50000 visas for Schedule A last year and 90000 this year from unused\recaptured visas. We should also be asking for our individual line item, 485 measure. This is how a war is won, one battle at a time. It is unrealistic to have an "all or nothing" attitude that people opposing 485 measure have. If the health industry lobby had such "all or nothing" attitude they would not have got the 50000 visas last year nor would they have been trying to get the 90000 this year. Hope we learn from them.

I called couple of Desi consultancies..and they told me that lot of thier I-140's aqre getting rejected in this conversion drama...since they are looking for finanacials of the companies and looking for $3 mil of profits..? well do you have anybody who successfully converted from Eb-2-3 please IM me which companies I could contact...
