I already mentioned in my previous posts (multiple posts with same matter for people like you and me, see it and understand it well) how we are getting more than 50k visas just for EB2 India. I am giving it here again the visa allotments for 2006 and 2007 years when theres vertical fallouts. Now its changed to horizontal fall outs.
Due to this as many of us think its not the EB3 India which is losing, but its EB3 ROW.

See the Total Employment Based Visa approvals for 2006 and 2007 159,081 and 162,176. But there are only 140,000 visas in EB category. The rest of the visas came from Family Based visas which are not used for the previous fiscal year. The share for each category: Each EB1, EB2 and EB3 should get 1/3 of 140,000 = 46,666. But due to the less demand in EB1 and EB2 ROW all the visas falling to EB3 ROW due to the Vertical falling.
EB1 ROW --> EB2 ROW --> EB3 ROW.
EB1 INDIA --> EB2 INDIA --> EB3 INDIA.
As theres not much demand for EB1 ROW and EB2 ROW, all the unused visas are going to fall to EB3 ROW. So from this time its going to be like Horizotal fall out like below.
EB1 ROW/EB1 INDIA --> EB2 ROW/ EB2India/ EB2China-->EB3ROW/EB3 INDIA.
So this time to fall any VISAS into EB3 ROW they have to pass through EB2 India/EB2 China. So this makes EB3 ROW dates would retrogress due to the decrease in visa numbers availabilty.
As I said each category would have 46,666. So EB1 and EB2 together will have around 93,332 visas. But in EB1+EB2 in 2006 about 50,000 visas approved and in 2007 about 70,000 visas approved. So for 2008 also asume the demand for EB1 and EB2 is 70,000. But the availability of VISAS are 93,332 as said above + unused family visas which come around 19,000+.
So for this 2008 fiscal year for EB2 India and China the total visa numbers availlable are
(93,332 +19,000) - 70,000 = 42,332.
So around 42 thousand + 9,800 (regular 7% of 140k) = around 52k Visas Just for India , because EB2 China was already Jan 2006 a year back. And I dont think it would take any considerable share in this 50k other than its regular 9,800 visas.
Get me back if you have any doubts.

We can argue over a few thousand here and there but the increase will be substantial as compared to prior years. The big caveat to all this is that USCIS/DOS continue the horizontal spill over from this point on.

Simple e.g. I like Target as a store. That doesn't mean I give Target money and let them give me whatever they want for that money. I want to know before hand what my money is getting me.
very true when you are talking about a person who walks into a store. But you are asking for Target's strategic plans, how many stores it will open in the next quarter, what is their marketing plan in regards to Walmart (their main competitor).

Every airlines has its onw set of issues - u will get the pinch only when shit hits the fan. My bags were stranded in Dubai and when I reached Chennai I had nothing with me except a small bag with no clothes.
The agents told me - if you have Indian passport then Emirates will give you $$ compensation per day but if you have American passport Emirates will give $$$ per day. They reimbursed me for 2 sets of clothes and shoes and $50 per day for three days because my bags arrived one by one on the third and fourth day after calling them everyday and pressurising them. If we did not call them - the bags would come slower than that. In Dubai the bags were in hot sun and I had choclates inside and somehow the cover broke and choclates melted and seeped through and a I think you all can imagine how it is.
What I am saying is - things are good everywhere unless we get into issues. Things were good until Retrogression hit us here. Now we complain about difference in treatment - but earlier wenever complained.
What I am saying is - when dealing with things outside of your home country - you cannot expect or assume fairness to you.

Please don't go to Law Offices of Mona T. Movafaghi, Merrimack, NH ..She accepted my case two weeks back and charged $4000 same day. She hasn't filed my case yet. She is not even responding to my phone call and she is NOT commiting anything. I couldn't come out of her, so much of frustration .....

I'm still wishing (and i'll be honest) USCIS come up with a reason/regulation/rule that will delay EAD for everyone until BEC people are able to file 485 OR in Oct they retrogress only till March 2005
This is not how you should have said, delay EAD for others just because people are struck at BEC. Comeon buddy show some wisdom, you should have said USCIS come out with a plan where as soon as BEC labor is cleared, they accept the applications for 485.
The reason i said that: the manpower/funds that will be spent on the 1M+ EADs can be made available to BECs (if possible) and get the BEC job done quicker. EADs will be delayed only by a few months. Also don't forget the "OR..." part dude.

How does the House version of SKIL compare blow by blow with the senate provisions for EB in CIR. Does House version of SKIL include recapture of unused visas as well as a raise which was part of the CIR. Compete America report only talks about excluding spouse and depenedents in the House SKIL version for EB visa numbers

Hence when our circumstances necessitate that we have to try to board the CIR train to our goals I consider it unfortunate.
On the other hand when it comes to H1b immigration, every H1b increase has corresponded with some sort of provision(mainly recapture) of EB visas also. H1b increase has tremendous support and pressure from the powerful capitalist forces in this country. Just see how the Wall street Journal and Pres.Bush gives publicity to this issue. I doubt pure EB provisions can get that sort of visibility in spite of the tremendous work of organisations like IV.
In that sense the H1b cap being exhausted indirectly gives our issue more visibility and is a good development. Lets wait until the 20K US masters cap is also filled, then publicity will increase even more.
All in all it looks good that something will work for us by the end of this year. The pressure is building on congress to do something about EB immigration.

Finally, I got the PIO card. It did not take long after sending a $20.00 MO, I got the PIO card in about a months time. The total time it took me was about 2 and 1/2 months...although they claim the processing time would be at the max. 45 business days.
The PIO card looks pathetic. Its hand written and the passport like book looks too cheap. Crap looking PIO card.
I saw the new PIO processing fee, includes the return postage, which is a good thing. No more calls to anybody asking to send again the postage fee...seems to me the Govt. of India, plugged this little hole.

Well, I just made my third call and the lady sounded quite confident that applications that have been received and are in processing are not affected by this and it's only NEW applications that would be coming in after July 2 that are affected. I understand what you're saying that they don't assign it but I have read before that they "assume" each application qualifies unless they eventually figure out otherwise. And now I am making my own assumption that if they assume it qualifies then it's assumed a visa is indirectly assigned? Wait, I'm confused:D.
I've noticed that it's hard to get someone who can sound like they are really sure of the information they're giving you. I wonder if they're reading from something or just guessing sometimes. i shouldn't have to use the internet to get my information, they should be the #1 information center, and they can't even do that.:(

I live in Lansing. However, I am out of town on 10/20. Can we have another option if it is not too much hassle for all of you?
Another note- Troy will be very far for people in Lansing, Grand rapids, Kalamazoo, Battle Creek and Jackson. If a place like Farmington Hills or Novi is selected, it would be easier for people from the West side to come. Food for thought.

Therefore, dependents will remain in H-4 status if the principal nonimmigrant is lawfully working pursuant to portability benefits.

The Service expects, therefore, to propose a rule that would afford H-lB beneficiaries, who are no longer working for the initial H-lB employer, some reasonable period of time such as 60 days after leaving the initial H-lB employer to begin working for a new H-lB petitioning employer under the portability provisions. It is important to note that such a proposed rule would not, of course, take effect until it has been published as a final rule, after notice and comment, and any revisions. Due to family constrains I might be taking some breaks in future which I think I can do with EAD(but not sure :confused:) and on pending I-485 ( I am the dependent of the Primary applicant of the GC).
On H1 I know for sure I cannot take this break for even 3 months without pay stubs. So I was working hard without breaks on H1.
But once I am on EAD status Am I allowed to take breaks between the contract jobs.
So My question is... Can a dependent of a primary applicant on an EAD, AOS pending status allowed to take breaks between jobs?

Please be considerate to your good employer and good attorney of yours. You do not want to burn bridges, when you leave. Give them at least 2-3 weeks notice. That is the least or at least work with them for 6 months since that is what the law would require you after getting GC.
