    It was the figure that the Kauffman Report found about a month ago when studying the potential for Reverse Brain Drain amongst other things. It as accurate a number that you will find.

    Remember, this is many years of cumulative build up of temporary work visas transferring to permanent residency path

    A total of 2.5M cases pending (AOS and naturalization), only 1.2M are ready for action.

    1.3M backlogged cases TOTAL (includes naturalization), out of which more than 800K are retrogresed family-based AOS petitions, and what looks like 30K EB petitions (cannot be approved due to statutory limits). 300K cases in namecheck, maybe 10% of them are EB (EB is about 13% of green cards), so we are having about 60K truly backloged EB cases in March 2007.

    We know that cases that are current and not stuck in FBI checks are being approved farily fast, so my gut feeling is they have maybe 50-80K EB cases in active adjudication. Let's double-check -- out of 1.2 million cases ready for action, about a half is naturalization, and from the other half, ~13% would be EB - yep, 80K (EBs are the easiest to approve because there are no interviews or tests, so the percentage is likely less than 13%).

    So, in March 2007 there were a total of no more than 140K pending cases in I-485 stage of stocessing. Now in June-August EVERYONE who had an approved LC got to apply, and there were ~300K applications, while CIS gave out ~70K green cards, so we would have a total of 370K pending petitions. This estimate is surprisingly close to 13% of the total 2.5M backlog, so I would consider it good.

    Again, I absolutely do not believe there are more than 500K EB1-EB3 cases. There may be another 500K in the 'other worker' category, but this is not what we are talking about here.

    I was under the impression that unused visas of one category ( EB/F ) may be used for the other category ( F/EB ) for the next year.
    Please correct me if I am wrong.

    Also I have no idea what that number exactly is. It is pbly somewhere in the uscis ombudsman report. Just too lazy today morning to look it up :D

    People in neighbouring states of DC did not make it , you think they will make it all the way to west coast! very doubtful!!

    I had lawmaker apointment (in Rayburn building across the street from where the rally ended) after the rally. There were 10 Indians giggling at me. At first I thought they attended the rally. I was walking in their direction when their looks got weird and I realized they did not attend the rally!

    Are you serious????? Are you sure it is I-485 application? not EAD application or something ?
    I am telling you...if your 485 got approved really, you are the luckiest person on this earth....if it is real, Congratulations!!!! enjoy!!! don't worry about why u got it....

    No its I-485 I just cut and pasted the two emails I received, first at 10am then the second at 3 pm check online and the system had same messages. If its true I am having a party wow man thanks I did come to US in 1997. I do have a labor which was approved under RIR PD date 2004 but the employer refused to file I-140. Then again filed PERM in 2007 under EB2 and filed I-140/I-485 based on this PERM

    Any thoughts on organizing rallys state capitals ?

    Good Idea...I had the same thought.....

    We should do this rally in all the 52(?) states on one day to make it more historic!....This way the Local State chapters will get motivated and media will always be there on the state capital.....

    Ideal would be a Friday afternoon....So people who don't want to take a day off, can just take few hours off and drive to the rally location...

    People/Media will forget these rallies very soon, Once some OJ news comes up....we should keep on knocking the door!!! crying baby gets milk :) ....lets keep trying till our goals met!

    Was ur application sent to Nebraska or Texas?
    I understand they are forwarding some appls to Texas from Nebraska.
    And Texas is much faster.


    I got to know from my attorney that, USCIS has my I 140 information in their system and they gave him a receipt number. But, the receipt is not generated yet. It may take a week or so to get the receipt. My appl was filed on 12th and it reached NSC on 13th.

    I checked the status online with this receipt # and online status shows that they recieved the aplication on 19th and its at Texas center. May be my appl was moved to Texas now.

    It is one way to reduce the budget deficit, each of us will be burning away $700- every year per head for AP + EAD renewal with close to a million applicants go do the maths.

    And AP/EAD renewal cannot start before 120 days so that time period every year for at least 3 years they are gonna laugh their guts out.

    And we thought we achieved a big feat with the July fiasco ......

    Air France still does not get it. neither do other euro nations, Nor does Australia.
    They are now dealing with a entirely different generation of Asians who do not care if they were once a developed nation or that they can manufacture aircrafts.

    The reply is still suggestive of they taking care of the passengers and handling the situation well. No, they did not.

    A technical aircraft problem is something that every airline faces everyday.
    Air France not having a plan to care of non-american or non-eurpoean indians is completely their fault and outright racist. and that too a flight which is flying to India?
    Did they expect everyone on the flight to be from a EU or North American nation, and that they will not require transit visas.

    No, they simply did not care. They just did not make arrangement for Indian residents and hid behind the transit visa excuse.
    If they wanted, they could have arranged for a Airport Transit visa for eveyone who did not have one.
    But no, they assumed that regardless of how we treat them, an indian is going to fly Air France again if that is the cheapest option.
    Funny is, that might be true, but that demographics is changing so fast that they better keep not caring, cos Indians will not fly with them anyways.

    EB2 is the only hope for all EB3-I folks bcoz EB3-I is last in the chain to get any spillover so you should not have any hopes in next 5 years.

    Dates will move one month per year for EB3-I in next 5 years unless a miracle happens.

    First of all,based on the information you provided i believe that
    1. You are continuously employed WITHOUT any gap, meaning working 40 hrs/ week and clean history of pay stubs, W2s etc
    2. You have been working for only one employer at any given point of time, as a full time employee
    IF What i said above is true, then RFE makes no sense. because based on the H1B rules and regulations, one can have multiple H1Bs BUT can only work for ONE employer as full time, meaning 40hrs/week.
    It is also completely legal that one can work up to 20hrs/week for second employer by paying proper taxes . but in your case i believe that you have worked for only one employer and i think you can show the evidence.
    Please contact your attorney and draft a response carefully

    The following are your words, aren't they? I am not sure how anyone could read this anything other than a suggestion that people in ROW category are unskilled and a worker from a oversubscribed country is skilled. You may be the most skilled, intelligent and smart person around here but rest of us can at least read and gather what you are trying to say.

    I have nothing against you but I wouldn't want people calling ROW folks unskilled. I know you were talking about EB3 ROW but there are ton of engineers, software designers, and many more who applied in EB3 (some by skill sets, some by force, and some by choice). They are not unskilled people by any stretch of imagination.

    .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher

    The problem with Per Country limits makes no sense when the same theory is applied to visa's granted because of Skill. Employability has nothing to do with ethnicity (in fact, there are laws that prevent this type of discrimination by employers). It just so happens that currently India and China, due to their educational focus has a lot of people with skills that American industry wants. Who knows, in 10 years this could change and those skills could come from Mauritius and Lichtenstein and then they would be backlogged instead.


    Franklin; I agree that per country quotas are discriminatory.

    What I am unsure about, is whether it is morally justifiable, and this hinges on whether it actually benefits the United States or not (many forms of discrimination against non-citizens are perfectly legal under the US constitution).

    I agree with Hermione, that given the current minuscule quotas the issue is moot (in fact, it was my intention to suggest exactly this, by pointing out that the last thing anyone needs to worry about is per-country quotas when the overall immigration levels are so tiny, and the per-country cap is so small).

    I am still on the fence, though, about the moral acceptability of per country quotas in the presence of rationale visa allocations (somewhere around 3 million per year by my estimate). I think at those levels (and with perhaps completely different percentages for the per-country quota) there may indeed be a moral justification (I simply don't know enough about cultural/social dynamics).

    I think everyone would agree that the US is certainly entitled to determine how it develops culturally (as is any country).

    In its present form of course, the immigration system is damaging the United States (e.g. RBD), so it is impossible for it to be morally acceptable from the US perspective (you can't balance the negative moral implications of discrimination against non-citizens, with the benefits to the citizens of the nation, when there are no benefits to the citizens of the nation).

    Significantly, it is most likely true that the present immigration policy is morally acceptable from (say) India's perspective, since it is resulting in improved retention of brain power for India...

    I am preparing I131 (AP) renewal application for me and my family. For my son, who is 8 years old, do I need to fill "Part 9. Signature of Person preparing the form, if other than the applicant" since I am preparing this form? OR can I just sign Part 8 on-behalf of my son?

    G-28 form says it needs to be filled in case if you use Attorney or Representative. Just wondering whether I need to fill a G-28 form for the above AP renewal application for my son since I am filling Part 9 in his application.

    Can somebody clarify? Thanks for your help.

    Because H4 visa holders can not legally work many of them work illegaly. It is very difficult choice they make, but thei somethimes don't have any other option. I have a friend who start working on J2 visa when her husbant was on J1, but after he changed to H1B she had to obtain H4. Because of the financial reasons she continued to work. She is a very smart and good person and I will be very angry and dissepointed at homeland security if they will not let her stay here and obtain green card.
