You EAD or AP may be approved at anytime while your 485 is pending, it is a derivative benefit of the pending 485 petition. If the 140 is rejected then everything collapses like a stack of dominos.

Can I apply for EAD for spouse on the basis of I-140 approval? I can not file I-485 due to retrogression and he is running out of her H1B visa limit.

Folks,
I know this may be a little of topic but just bear with me. I am simply looking at alternatives in case the GC does not pull through. Does any one over here have any experiences living and working in the Middle east ? I just read an article about Saudi Arabia's economy dealing with record unemployment. They are in the process of taking jobs away from foreigners and giving it to the locals.
Where do we go to look for jobs in the Middle east. Any advice on this topic would be greatly appreciated. I'm praying my GC does finally pull through.

I am...but most of you ain't, so I figured that it made more sense to use an image you'd be more familiar with.

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

Harry Reid says he's got 60 votes to support an immigration reform bill. That's a pretty confident tone he's taking and I hope he's right. And for those of you who say that you don't have provisions in the bill helping your group - particularly employment immigration advocates - I'll remind you that the immigration reform bill is what is standing in the way of many other bills moving forward. Once it is passed, we should be back in a normal environment where other problems can be more easily addressed.

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. My office has replied to RFE and as per tracking it is delivered today.

Need your input in a scenario of a friend of mine. My friend's wife is on H1 for the past 4 months and wants to transfer to an H4 visa under her husband. The wife's employer has not paid her any salary nor has he got her any project for the past 4-5 months, hence they are forced to make this decision. The h1 my friend's wife is only H1 approval papers and it is not stamped on her passport. The wife's employer is not willing to give her any papers of release or letter of leave without pay from her employment.
She needs to desperatly change her status to H4.....Suggestions needed??
Question=> Can my friend's wife go to India and apply for a H4 visa directly from the US Consulate in India? Without any papers related to the H1 visa??

I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.
Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?
Please advise.

When a particular priority date becomes current in the next month's bulletin,say the July bulletin. Does USCIS start looking at the current cases once the July bulletin is issued or starts looking at them from July 1st.
