No, you don't need the I-864. The interview letter that you got might refer to an I-864, but this is often because the local district office has standard interview letters and they are more often for family cases than employment cases. I've seen this happen often.

Any one had luck refiling I140 in EB3 for denied EB2 I140 (for same labor)?

You may be able to stay without a job as long as the future job offer is still open and the gc sponsoring employer has an intent to hire you after the 485 is approved. Please confirm with your immig attny

Hi,
I have my EAD/AP. I'm EB3-I.
I paid my attorney for the 485 processing. But the law firm works for my company.
They have been good so far (law firm) but I guess it would be better for me to first change the attorney If I plan to file AC21.
I would appreciate it if someone can suggest me good attorney . What would be the fee I can be looking at to pay the new attorney at this point of my GC. processing( With EAD/AP ..renewal also taken care.)
(If it is not appropriate to mention the figure I would appreciate it if someone can just give me a range/ballpark figure)

The question is:
Can i file GC under PERM for the new role ( same company) in California. Assuming the PERM LC gets approved, can i port the PD of Oct 2004?

I am working on EAD which I received from my EB3 category(labor date - Oct, 2004). My new employer filed a new application for EB2 category in Nov, 2010, my labor got approved within 3 months and they went for the next step filing my I-140 PETITION. They attached my previous I-140( from Eb3 category) along with the new application seeking to port the old priority date. Here is the REF which they received on 23, March 2011.
"Please provide evidence to show that the petitioner will be employing the beneficiary to fill the specific vacancy. In addition, provide a detail description of the work to be performed, including specific job duties, level of responsibility and number of hours per week of work to be performed.
You must sumbit the requested information within 30 days from the date of this letter. Failure to do so may result in the denial of your petition"
Please suggest. My attorney is working on this.

Hi,
I have an approved I-140 with my current employer. I have an offer from another employer that I am considering but the new employer will only transfer the H1B and not sponsor the GC.
Q1: Can I transfer my visa and start working for new employer and keep the GC process with the old employer if they agree to keep the offer open?
Q2: After visa transfer, if my PD becomes current, can I file I-485 with the old employer while working for the new employer?
I really appreciate any help.

I am on US since Apr 2003 on L1B and it expires on Jan 25 2008
Last week my employer applied for L1A and it got approved. Approval notice says the new L1A visa is valid from Jan 26 2008 to Jan 26 2010(2 years)
I am planning to travel to india on vacation at dec 2007 and come back to US on Jan 1 2008
1) If I travel back to US on Jan 1 2008 without stamping L1A on passport, will the port of entry officer give I94 till Jan 26 2010 if I show the approved L1A I797 petition?
2) If I stamp L1A from India, when stamping the new L1A, I assume they will cancel my current L1B and stamp L1A which is valid only from Jan 26 2008. Am I correct? Then I will not be able to travel on Jan 1st 2008 since I dont have a valid visa stamped on passport at that time!
What to do ....Please help!

Hi,
I have an F1 visa that expires on July 11'th 2009.
I am currently on OPT and working. My OPT lasts for another 10 months.
I have just got my H1B application approved in the latest round and am allowed to get it stamped only after October. Therefore between July 11'th (end of F1 visa) and October (stamping of H1), I will be in the US without a valid visa but with a valid OPT.
I need to go to India in June and return on July 10'th- 1 day before F1 visa expires. Am I allowed to re-enter the US with 1 day of visa validity? What documents do I need to carry with me? How should I show them that my H1B is approved and will be stamped in October?
Will they let me back into the country knowing that starting 1 day later I will be without a valid visa until I travel outside the country in October to get my H1B stamped?

This might be little bit old, but I dont remember seeing a post on this. Employment-based immigrant visa fees almost doubled, Old fees $ 355, new fees $ 720 from July 13th. Does this mean USCIS will open the gates in Sept bulletin [to be released in August]?

I am on L1A at present and my full 7 year term is expiring in DEC-2012. My company could not file EB1-Int'l Executive or manager due to ownership changes etc. But they are considering EB2 and I was told that it will be risky as I would be required to convert to H1B before that and I would lose one year of stay.
Can someone advise whether my company can apply for extension of my L1A beyond the 7 years, if it files for EB2 and would be pending for approval, instead of going through the issue of converting to H1B?

Yes in Montreal, Canada on Aug 26th, 2009. All is well. I got my h1b visa renewed for 3 years. They had to do electronic followup since my LIN is not found in PIMS. But I got my passport, visa next day at 3pm.
