Hello,
I am in my 10th year of H1B visa. (GC in process). Every other time I went to INDIA , I got my stamping in INDIA except in 2009 when I returned on Advanced Parole because of a lack of time. Now I need to go to INDIA again in July and I observed this condition for visa stamping at INDIAN consulates which is :
Have the same class of U.S. visa which is still valid or that has expired less than 12 months from the scheduled date of interview.
Wish to apply for the same visa class (e.g. had an H1 work visa, now applying again for an H1 work visa)
My question is whether my last entry to US on Advanced Parole will be interpreted as not having the same class of VISA. After I entered on AP , I did renew my H1 Visa and it is valid upto April'2011.

I am not sure what is so important in this to answer.
As long as thay had sent the finger prints to you, you should be OK. There is no particular pattern in which they send the EAD cards. So, no body can answer your question about when will you get the EAD. Just pray and watch. If it is more than 90 days since you have applied for your EAD, then you may contact your local office to expedite the process.

In addition to contacting the law makers, we should be contacting the media to highlight our plight. I just read on IP that the media is unaware of the BEC mess (http://www.immigrationportal.com/showpost.php?p=1406956&postcount=3019) and would be interested in taking it up. My lawyer just told me, that Canadian citizens have the privilege to get H-4 stamped at the border & do not need to go the US consulates in Canada. Just wanted to ask that if this true and if someone has been through it.
Are there specific Land Borders where stamping can be done? or does it works at every Border post?
Is there a border post in the Minnesota or North Dakota area where this can be done? My wife lives in a small town in Manitoba.
Does she have to take all her pictures or will they take picture there for the visa? & what else would we need? non-immigrant forms etc. Any experiences?? I know they will need my H-1 Petition copy, pay stubs, marriage certificate, pictures of marriage etc.

Lots of activity to report. Congressional Hispanic Caucus leaders met this week with President Obama who said he wants a vote during the Lame Duck and would work the phones to round up votes. Guys:
just talked to an IO at Nebraska and was told that my file is waiting for an officer to look at.
When I asked how long will it be before they get to it, she says they have like 500 cases each but that I should be hearing something soon?
Any ideas ...how soon ? Has anyone else had a similar conversation and how long did it take before they heard something??
I know there is nothing definate...but just wanting to share and hear back if anyone had similar experience.

My sister applied for her EAD renewal online and paid $340 for it. She filed her I 485 in Oct 2007. There are instructions on the I 765 form that there is no fee for those who filed there first EAD after July 2007. So would that fee be refunded? Has anyone experienced this kind of thing?

I was keep observing the PERM approval rate trend for the past one year. Approval rate is very slow. But it is suddently jumped since last month. Looks like it is a good time to start filing another labor. I am in the same boat. Trying for a new employer for EB2.
