My old friend Bernie Wolfsdorf is at this moment addressing the American Immigration Lawyers Association where he takes the helm as the 10,000+ organization's newest president. Bernie came here 30 years ago from South Africa and has built up a great immigration practice in Southern California. He leads the organization at a critical time. There are new crises everyday and a system that is broken at nearly every level. Fortunately, the pro-immigrant community has a great leader in Bernie who has been a tireless advocate for decades. Good luck, Bernie!

I'm Australian and would like to return to the U.S. to visit in-laws with my partner but I overstayed my visa on my last visit.
On my last visit, I received a 6-month visitor visa then extended my visa another 6 months. I overstayed my visa by 11 weeks; I was helping my same-sex partner move. This was two years ago. I did not work for anyone while in the States.
What can I do if any to improve my chances of not getting turned away at Immigration?
Thanks for any help.

My aunt (fathers sister) is separated (not divorced) from her husband for over 17 years now. She and her 24 year old son (who was 7 years old when his parents separated) live with our family for last 17 years. Her application for visitor visa was rejected in year 2003 when I had invited her to attend my graduation ceremony. At that time I had not sent a sponsor letter. I have invited her to visit me again and this time I am sponsoring for her visit. She owns a house in India and her son owns a business.
Would her marital status (separated but not divorced) create any issues during the interview?

Hi,
I am working with a consulting company and my company filed for my GC in 2009 (PD is 25-Feb-2009). I received my I-140 approval on 28-Feb-2010. Now the client where I am working, has offered my a fulltime job and GC processing. I have received mutual consent from my current company for any legal issues. Now, if I join the new company and file my GC from there, can I port my Priority date for the new processing? Also, what should be the earliest joining date? What all other precautions should I take while filing GC with the new company?
I received the offer on 07/09 and have to give my decision by 07/15. I would appreciate if anyone can help.
Thanks a lot,
CAH

Please help reactivate this group. We have 27 members on our group but it's hard to get 1 reply. We have successfully met two lawmakers recently and more such contacts are urgently needed. If one has EB1 (Extraordinary Ability) Pending, is one allowed to stay in the US until the case is decided? I know it may takes at least an year for the final approval...

I130 petition shows an "immigrant intent" so that could come up as a ground of not allowing a person into the U.S. on a purely non-immigrant visa. I would suggest to speak to an attorney.

The most frequent question that we receive is How do I choose a good immigration attorney? Our response is Why settle for good? Read on. There are websites for finding excellent hotels, wonderful restaurants and great physicians. How about a site for choosing an attorney? See http://www.avvo.com During the past year, Avvo has emerged as the premier site for selecting an attorney. Avvo, short for avvocaat (Italian for attorney), is gaining not only in popularity but in usefulness. Great immigration attorneys will tell you that by the time 30% of potential clients consult with them, some incompetent attorney or consultant...

Hello all,
I entered US on a valid h4 visa on june 2007.Filed for a h1b on march 2008 and got and stamped h1 on sep 2008.Cud not find job due to recession.Converted back to h4 on oct 2009.I have following questions
1) Is it possible to convert back to H1 or fresh H1 ?
2) will the time period i spent on h4 will be counted for my h1?
3) When i stamped my h1b earlier(oct 2008) it showed validity till sep 2011.Does that mean I have to apply h4 to h1 before that?
4) In case if i get a RFE on converting from h4 to h1 Can i stay back on my existing h4 visa?
5) I havnt ever worked on my H1 will that affect my conversion from h4 to h1 now?
It will be great if you can answer these questions.
Thanks,
Lucky

Hi,
I have an interview scheduled for my H1B revalidation stamping at the Mumbai consulate next week. My son will be accompanying me for his H4 stamping.
My wife is already in the US(she travelled using her AP).
The FAQ page of the Chennai consulate says that incase both parents are not accompanying the child for the interview, then the absent parent must submit a signed and notarized 'no objection certificate' to the parent going for the interview. There is no such mention on the Mumbai consulate FAQ page.
Question - Does this apply in my case - since my wife is already in the US ?
Thanks for the help.

It is very unlikely that a physical therapist would qualify for a national interest waiver. You need to show exceptional ability in the sciences, arts, or business and that you will substantially benefit the national economy, cultural, or educational interests or welfare of the United States.
