The documentary series In their Boots premieres a new episode this week on immigration problems facing military families. I've tried to highlight those problems in this blog and am glad that a serious documentary filmmaker has taken on the subject. The episode is entitled Second Battle and here is a synopsis: Sgt. My wife's H1B got approved earlier this week through company A. Company B also made an offer last month but they are still working on the H1B visa issue with the attorney.
So, my question is if this company (B) files H1B now, then it should be a "transfer (not subject to quota)" or "new petition (subject to quota)"?
I think she is already on H1B as of today with COS effective immediately approval so any new employer can only apply for transfer and they don't need to ask for COS. We will not have pay-stubs to transfer as we are still to receive the I-797 copy and apply for SSN so that payroll can be run for her.
Please let me know if anybody has got any insight on this situation. Very much appreciate your time.

Yes, I did get a business checkin card. Credit card, I guess, I can get only when the EIN number develops some history. Do you already have a business checking card?

Hello all,
Form I-693 downloading from the following site is valid until 6/30/07.
Is it ok to use this form though we will be filing the I-485 on 07/01/07.

As long as you get your medicals done before 6/30/07 you should be fine.

The annual Consumer Electronics Show kicks off this week in Las Vegas. This is the gadget wonderland I've attended for the last several years. Due to my father's illness, I decided to skip this year's show. But I'm avidly watching online for announcements of the year's best new innovations. I am on H1B all these days and my company wants me to mandatory move to EAD. (no option here). I also had my H1B approved for an other 3 years.
1) Is it a good idea to move on EAD now.
2)Its been close to 6 years on my H1 but I still have 8 months left on the initial 6 years. Can i use the left out period on H1B later.
3)Now that I am on EAD, if i need to move my employer, can I invoke the AC21. if yes what should I do... do i just need to resign at the current place and join at the company b.
4)If I move out of my current employer,Can my employer revoke the I140, considering that its already been more than 180days since approved.
Note: I have my 485 pending and 140 approved in April 2008 and I am a July 2007 filer with a priority date of June 24th 2007.

Friends : I meant to start this thread for updates pertaining to applicants whose applications are receipted from NSC, TSC and other centres, but still waiting to recieve their finger printings notices, EAD cards and advance parole too.

Hello all,
I entered US on a valid h4 visa on june 2007.Filed for a h1b on march 2008 and got and stamped h1 on sep 2008.Cud not find job due to recession.Converted back to h4 on oct 2009.I have following questions
1) Is it possible to convert back to H1 or fresh H1 ?
2) will the time period i spent on h4 will be counted for my h1?
3) When i stamped my h1b earlier(oct 2008) it showed validity till sep 2011.Does that mean I have to apply h4 to h1 before that?
4) In case if i get a RFE on converting from h4 to h1 Can i stay back on my existing h4 visa?
5) I havnt ever worked on my H1 will that affect my conversion from h4 to h1 now?
It will be great if you can answer these questions.

a) H1 extension(I797) approved but no I94
b) Visa stamp and I-94 expired when I applied ( my mistake)for extension but I-797 was valid. Have EAD and Advance Paroll
c) Wife is on H4 and I cannot add her to greencard process because priority date is not current.
d) I need to maintain H1 for my wife.
e) She returned to India before her H4 expired.
f) I work at a client location via a middle vendor so recently found out it does not conform to H1 employer-employee relationship.
1) Is there any time restriction on when I should get Visa stamping done?
2) Client agreed to give client letter but I am worried that I will be rejected at H1 visa stamping because of employer employee relationship requirement.
3) Is it a better startegy to not go to India, send my wife for H4 stamping and bring her to US or is it safer for me to go for H1 visa stamping?
4) Should I change jobs to a client who will transfer H1 and continue my greencard (possibly apply for EB2) before going to India for H1 stamping?
5) Please suggest best course of action.

Are you referring to Silverlight? If so, there is currently no easy way of doing that outside of you manually breaking text apart into two separate text block entries.
