If the EB system is categorized by country quota, what is what would be the apparent use of capturing data without the unlerlying country of origin of the applicant?
If the data is truly not available, what system are they using to anticipate demand and inform the DOS?
Based on the reply to this FOIA from Needhelp!, it seems that we have a bigger problem than transparency.
They have said that country of chargeability is not assigned until case is ready for approval. However, whether or not a case is ready for approval is determined by country of chargeability. If you have 500,000 pending cases and dont know how many cases for each country of chargeability, then the only way to respond to a visa bulletin is to go thru all 500,000 cases every month, take a peek in it, look at the PD, look at the country and see if it is up for approval. I dont think they are doing that.
Also, if priority date is something that is different for different countries, then cases for those countries have to be sorted by priority date in different silos, so that when the next bulletin comes, you know how many cases are eligible that month and which ones are the earliest cases (from PD perspective) for each country.

Very well said IV and I can tell you that you may very well be right when you say that 90% of people trust you guys. I am proud to be supporting an organization like IV and will continue to do so till we get success. It is not easy now and it was not meant to be easy but hey we will get there. I understand that you guys are frustrated but I did not open this thread to make empty noise. I have written to six different organisations and ACLJ only gave me a reply that they would be unable to process our per courntry quota lawsuit. There are thousands of federal court immigration lawyers in the country who would do this lawsuit albeit with more money than these non profit organisations. If any of you guys want to make a difference in your lives and lives of others pls co-ordinate this event of contacting various immigration lawyers.

Make no mistakes, I would like to change the course of events. Otherwise I wouldn't be here, and I wouldn't have walked those two miles in DC with the rest of my brethren! My experience with FDBL ( Filed through #1 DataStorage Firm) has been good till now. Informed well ahead, filed on time. LC processing took a bit b/c of general LC filing norms but LC cleared in 20 days and I140 in 7 days. Guess they did their paperwork and all right.

Wait for labor (go through labor pain..:-) ), do not get/expect promotion, Oh ya get your well educated spouse, Make them sit at home, make them feel unproductive, pay all your taxes, pay your social security BUT do not expect anything back, In the process if your kids age out separate them from you (send them back), If you wish to study pay highest fees, if you get promoted stand in queue again, pay frequent medical fees, AP, EAD fees, and yes YOU can always TRACK RNs for them. You can whine, post your opinions, when we change policies on the fly and create more hardships even if you have stayed here for more than 6 years, you can call up our customer service, be imaginative and get to level 2 and still get yelled at, asked to wait for 90 days (std reply), etc, but you can always go to good forum like IV and instead of working on your cause, create confusion, DEMAND action, not contribute....etc.

This is yet another example of how the US is happy to tax us and let us finance Social Security, then place us in a similar category to "illegal aliens" when it suits them. Please give results on any legal redress as soon as you have them, as I will join also. I have already written to Congressman Chris Van Hollen of Maryland about this.

Agree with you 100%. Instead of 'forming' state chapters in the last moment, they need to be established, nourished, strengthened and developed over a period of time. A grassroots movement needs strong roots in all regions.
I was also thinking that we can possibly learn a lot from the protests by undocumented immigrants. They had record turnouts in their rallies and most of their people stayed away from work to take part in the efforts when ever there was a call for the same.
With all due respect, it was a disaster. They ended up scaring Americans - by holding Flags of thier countries, holding US flag upside-down or disrespecting US flag in other ways. This provided fodder to anti-immigrants to scare Americans of an 'invasion' of law-breaking aliens.
We need to learn lessons from them, in not committing their mistakes
Some of the advantages of having simultaneous local rallies is that
1) No travel expenses � (So that we can spend more money on media and lobbying than travel expenses)
There was a Free Bus from NY/NJ. Yet, how many came?
2) No need to time spent on travel � ( Better turnouts)
How many people from DC participated?
3) Comfort � every one can just go to a local rally point (Better turnouts)
Those seeking 'comfort', will choose it at home. What better comfort than to sleep on a couch and watch TV?
4) Stronger regional chapters � (work at grass root levels)
If wishes were horses...
As of now, idea doesn't look good. 10 people marching in Detroit, 20 in Minneapolis, 40 in New York, 100 in California - will it even be a rally, in the true sense?

Bestin: the core is involved. Some of the core are just very busy on IV stuff. I spoke with Aman last week he called me from the airport -- a trip to DC. Some people are cagey about handing out personal details and while it is frustrating let's have some respect. I'm one of the few who puts their full name in signature, and my user id is my name, and I say I'm from NY, so it only takes a telephone directory search to find my phone number and address. But you won't hear me calling people names for not giving contact details. Some people are more reserved than others, for example, my wife used to live in a communist police state where the state was out to get you, so she is more reserved. Frustrating I know. Enough said, let's look for positive things to do.
SO ON THE POSITIVE SIDE:
I got another 33 letters this week, and expect about same next week, and have 2 US citizens who will likely get me another 20. So I might make 100+.
My total in hand so far: 43
I'd be happy to continue for several weeks or months, but will go with what the core decides for drawing the line.
TIP:
Where you know someone who works at a different place to you ask them to collect some letters from their work place and give them to you or mail them to you. I'm expecting to get at least 20 that way next week alone, maybe more later.

Frankly speaking, i am not a sufferer from BEC, but i want to know more about this mess.
Does the FIFO means, they process the applications in FIFO order, Does it mean that they approve also in the FIFO order? I think both processing and approving are different. Whoever got the case with less complications, will first get the approval and whose case got more complications, takes more time. Is it correct? I may be wrong. I think thats the reason why 2004 PDs may come out BEC fast sometimes as they put the case strongly and clearly.

My case was filed in 2002 under traditional labor certification. DOL never questioned anything or asked for any clarifications (so I assume there were no complications). The job was advertised in last April (it was a little newspaper advertisement with few lines and very generic job requirements). There were no resumes received. But still I have not received my labor approval. So what baffles me most is why has the DOL been not able to taken any decision on my case even after 5 years. One of my friends who applied in traditional labor two years after me has already received his LC. Let us say, for argument sake, the case was complicated. How complicated can it be to be delayed by several years, not months? We probably would get answers to these questions only if we drag the DOL to court and make them explain.

I contacted the lawyers a few times to see what they were doing and they said they were working on it. But to be honest, I got tired of doing this on my own, and the lack of updates from the lawyers makes me doubt that anything will be done.
In fact, the current economic situation casts doubt on my employment, so I am not sure how long I will be in the US. Hopefully I can ride this out, but obviously I have other things on my mind. I need at least one more year working in the US to be eligible for social security. So I am keeping my fingers crossed.

h4hopeful, I am sorry to reply late. EAD lets you work. you can get EAD when your H4 spouse applies the I-485 (third stage of GC), he can also apply I-765 which will get you also an EAD along with your spouse. In order to apply for I-485 the visa numbers should be current for your spouse's priority date (Date on which your spouse's company initiated the GC process filing Labor Certification). Currently for India and CHina the dates are heavilyt backlogged. ImmigrationVoice is making our voices heard in the congress so we may get some relief. But we can only be hopeful about this, for an infinite period of time. We cannot help other than saying sorry to each other.
